Welcome to Lumira Glass LLC (“Lumira Glass,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at lumiraglassllc.com (the “Site”) and the glass installation, repair, replacement, fabrication, and related services we provide (collectively, the “Services”). By accessing the Site, requesting a quote, or engaging us for Services, you agree to be bound by these Terms.

1. Services Provided

Lumira Glass LLC offers residential and commercial glass services including, but not limited to, shower enclosures, mirrors, window repair and replacement, storefront glass, custom glass fabrication, and related installation work in and around Charlotte, North Carolina. The scope, materials, timelines, and pricing of any project will be set out in a written quote, estimate, work order, or contract (the “Project Agreement”). The Project Agreement, together with these Terms, forms the complete agreement between you and Lumira Glass for that project.

2. Quotes and Estimates

All quotes and estimates are valid for thirty (30) days from the date issued unless stated otherwise in writing. Pricing is based on the information you provide, on-site measurements, and current material costs. We reserve the right to revise an estimate if site conditions, dimensions, or material costs change materially before installation begins. Any change will be communicated to you in writing for your approval before work proceeds.

3. Deposits, Payments, and Late Charges

Most projects require a non-refundable deposit before materials are ordered or fabrication begins. The deposit amount and final payment schedule will be stated in the Project Agreement. Final payment is due upon completion of installation unless otherwise agreed in writing. Past-due balances may accrue a late fee of 1.5% per month (or the maximum amount permitted by North Carolina law, whichever is lower) until paid in full. You agree to reimburse Lumira Glass for reasonable collection costs and attorneys’ fees incurred to collect any unpaid balance.

4. Cancellations and Refunds

Because much of our glass is custom-cut to your specifications, cancellations made after materials have been ordered, fabricated, or tempered are non-refundable. Cancellations made before fabrication begins are eligible for a refund of any payment made, less a reasonable administrative fee and any costs already incurred on your behalf. Refund requests must be submitted in writing to our office.

5. Scheduling, Access, and Site Conditions

You agree to provide safe, unobstructed access to the work area at the scheduled installation time, including parking, electricity, and any necessary clearances. Delays caused by inaccessible job sites, incorrect information, undisclosed structural issues, or the actions of other trades on site may result in rescheduling fees or change orders. Lumira Glass is not responsible for delays caused by weather, supplier shortages, carriers, manufacturer defects, or other events outside of our reasonable control.

6. Workmanship and Manufacturer Warranties

We warrant our installation workmanship to be free from defects for a period of one (1) year from the date of installation, unless a different period is stated in the Project Agreement. Glass, hardware, and finished products carry only the warranties offered by their respective manufacturers, which we will pass through to you. Warranty service does not cover damage caused by misuse, abuse, accidents, alterations by others, severe weather, settling, normal wear, hard-water buildup, or failure to follow the care instructions we provide. To make a warranty claim, contact us in writing with photos and a description of the issue.

7. Customer Responsibilities

You are responsible for confirming dimensions, finishes, glass type, hardware selection, and any other project specifications shown in the Project Agreement before fabrication begins. You are also responsible for obtaining any HOA, condo association, landlord, or municipal approvals required for the work. Lumira Glass is not liable for fabricated product produced to your approved specifications that you later determine to be unsuitable.

8. Limitation of Liability

To the fullest extent permitted by law, Lumira Glass LLC’s total liability arising out of or relating to the Services or these Terms shall not exceed the total amount you paid for the project at issue. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, loss of use, or damage to unrelated property, even if advised of the possibility of such damages. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited under North Carolina law.

9. Use of the Website

The content on this Site, including text, photographs, logos, designs, and graphics, is owned by or licensed to Lumira Glass LLC and is protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written permission. You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site or interfere with another user’s use.

10. Third-Party Links and Reviews

The Site may include links to or embeds from third-party services such as Google, Meta, Instagram, review platforms, and scheduling tools. Lumira Glass is not responsible for the content, accuracy, or practices of those third parties. Your use of those services is governed by their own terms and privacy policies.

11. Marketing Photos and Testimonials

Unless you tell us otherwise in writing, you grant Lumira Glass a non-exclusive, royalty-free right to photograph completed work and to use those photographs, along with any testimonial or review you voluntarily provide, in our marketing materials and on our website and social media channels. We will not include personally identifying information beyond a first name and city without your consent.

12. Privacy

Your use of the Site and our Services is also subject to our Privacy Policy, which describes how we collect and handle information. By using the Site, you consent to that handling.

13. Governing Law and Disputes

These Terms and any Project Agreement are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. The parties agree to attempt to resolve any dispute informally first. If a dispute cannot be resolved, the exclusive venue for any legal action will be the state or federal courts located in Mecklenburg County, North Carolina, and each party consents to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top reflects the most recent revision. Continued use of the Site or our Services after a revision is posted constitutes acceptance of the updated Terms.
